We are pleased to announce that Kara Hilburger’s article, ‘Addressing the Gap: Understanding the mismatched requirements between HIPAA and state privacy laws,' has been published in the May 2023 issue of Compliance Today® Magazine.
Kara’s article provides an overview of how and when state privacy laws may apply to organizations in the healthcare space, including some Covered Entities and Business Associates already complying with HIPAA. The article discusses the limitations of the HIPAA exceptions in state privacy regulation, especially under the California Consumer Protection Act (CPPA) and Colorado Privacy Act (CPA), and provides detailed insight into where the privacy requirements under HIPAA and the state privacy regulations differ, such as when it comes to the scope of the information included, data subject rights, and permitted uses and disclosures of the regulated data. The article concludes by outlining what steps an organization can take to address both requirements and maintain compliance with both laws and provides tips on how to best address these discrepancies and conflicts between the requirements of the privacy laws.
